1) Scope & Acceptance
These Terms apply to your use of our website, your purchase of merchandise, and any booking of our band for shows and events. By using the site, placing an order, or confirming a booking, you agree to these Terms and any Booking Confirmation/Rider we issue for a specific event.
2) Order of Precedence
If there’s a conflict, this order controls:
- Signed Booking Confirmation/Rider/Statement of Work (for that event)
- These Terms of Service
- Any other site notices (e.g., FAQs)
3) Online Store (Merch)
Products & pricing. We may change products, prices, and promotions at any time. Colors/placement may vary slightly due to print-on-demand processes.
Payments. Cards are processed via WooPayments/Stripe; wallets via Apple Pay/Google Pay; PayPal wallet is also available. We do not store full card numbers.
Taxes & shipping. Calculated at checkout; items ship from our print-on-demand partner or their carriers.
Returns & refunds. Our merch is made-to-order. No returns/exchanges for size or change-of-mind. For damaged/defective/misprinted items, contact support@hazardcountymusic.com within 30 days of delivery with photos—we will replace or refund the item cost. See Returns & Refunds for full details.
Risk of loss. Title and risk pass when a package is given to the carrier. If a package is returned to sender or undeliverable, we can reship within 30 days of notice; additional shipping charges apply.
4) Bookings (Shows & Events)
These general booking terms apply unless your Booking Confirmation/Rider states otherwise.
Quotes & deposit. Dates are not secured until we receive a signed confirmation and a 50% non-refundable deposit. Balance is due [on event day/before downbeat/within 1 day] as stated in your confirmation.
Client responsibilities. Provide safe performance area, adequate power, permitted access, parking/loading, and compliance with venue rules, sound ordinances, and curfew.
Schedules. Client agrees to published load-in, soundcheck, and show times; material delays caused by Client may shorten performance without fee reduction.
Weather/outdoor events. Client must provide weather protection. We may pause/stop if conditions are unsafe (rain, lightning, extreme temps).
Cancellations/rescheduling.

Client cancellation: more than 30 days prior → deposit retained, balance waived; 30 days or less → 100% of fee due (less amounts already paid).

Artist cancellation: if we must cancel due to illness, emergency, or force majeure, we’ll refund amounts paid and use reasonable efforts to help find a comparable replacement act.
Overtime & holdover. Any performance or on-site hold beyond the contracted end time is billed in 30-minute increments, rounded up. Rate is shown in your Booking Confirmation. If not listed, our standard rates apply:

Bars/Clubs: $250 per 30 min (band)

Private/Weddings: $500 per 30 min (band)

Corporate: $800 per 30 min (band)

Sound engineer/crew (if present): +$100 per 30 min each
Overtime is subject to venue curfew/noise rules and our discretion for safety. Overtime is due night-of unless otherwise agreed.
Recording & media. Client may film for personal/social use. Commercial use requires our written consent. We may capture photos/video of the event for our promotion unless you object in writing in advance.
5) Intellectual Property
All music, recordings, photos, videos, artwork, logos, and site content are owned by HCM or our licensors. You may not use our IP commercially without permission. If you submit reviews/photos, you grant us a non-exclusive license to display and promote them (credit where practical).
6) Acceptable Use (Site)
Don’t use the site for unlawful, infringing, harmful, or abusive purposes; don’t attempt to scrape, hack, or disrupt our services.
7) Disclaimers
The site, merch, and services are provided “as is.” To the fullest extent permitted by law, we disclaim all warranties, express or implied (including merchantability, fitness for a particular purpose, and non-infringement). Live events involve inherent risks; Client is responsible for providing a safe environment.
8) Limitation of Liability
To the maximum extent permitted by law, HCM’s total liability for any claim related to the site, merch, or a performance will not exceed the amount you paid to HCM in the 12 months prior to the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages.
9) Indemnification
You agree to indemnify and hold HCM, our members, and crew harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the site, or failure to provide a safe venue.
10) Privacy
See our Privacy Policy for how we collect and use information. By using the site, you consent to our Privacy Policy.
11) Governing Law; Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Exclusive venue lies in the state or federal courts located in Tarrant County, Texas, except claims suitable for small-claims court.
12) Force Majeure
Neither party is liable for delays or failures caused by events beyond reasonable control (e.g., severe weather, acts of God, government orders, strikes, pandemic restrictions). Obligations to pay amounts already due remain.
13) Changes
We may update these Terms; the effective date will reflect the latest version. Continued use after changes means you accept them.
